Because of the “claims made” nature of Professional Indemnity insurance you must advise your insurer during the current policy if you become aware of a circumstance that may give rise to a claim, failure to do so may prejudice your entitlement to indemnity under your policy. The most common cause of denial of claims by insurers is the failure by the insured to notify the insurer of the matter during the relevant policy period. If you are unsure whether a matter is a “circumstance” it should be discussed with your broker with the golden rule being when it doubt, notify!
